Update on Pay loss Court Case/s at CAT Ernakulam: Once again Final hearing in Pay loss court case filed by SNEA scheduled on 02/01/2026, is postponed due to second case filed on the same subject matter.
Actually hearing in Original case filed by SNEA vide OA No. 694/2022 at CAT Ernakulam on pay loss faced by the LICE JTO/JAO during JE period was responded by reply by BSNL, then rejoinder by SNEA and then heard in detail and after completion of hearing on 31/10/2024 it was listed for final hearing on 04/12/2024.
However on the same day, the applicant in the second OA on the subject by Shri. Anup Das JTO Kerala, vide OA No. 405/2023 suddenly requested Hon. Court that their OA being on subject matter, may be tagged with OA of SNEA and prayed that both matters be may be heard jointly.
Since then hearing in the on this second OA in joint case was held on six dates i.e. on 11/03/2025, 16/06/2025, 11/07/2025, 30/10/2025, 19/11/2025 and 02/01/2026 restarting process of calling replies from respondents, submission of rejoinders of second OA.
But no action is required and taken in case filed by SNEA.
In the hearing dated 19/11/2025 after on submission of reply by BSNL in second OA, the Honourable Court asked applicants in this second OA for filing rejoinder which is normal practice but the advocate of applicant in second OA has conveyed that they do not wish to submit any rejoinder. Thus case was listed for final hearing on 02/01/2026.
But on this date 02/01/2026 also, the applicant and respondent were not ready for final hearing and Honourable court recorded same and removed the case from disposal list. Copy <<<>>
If applicant and respondent would have been ready, the matter of pay loss would have been decided by Honourable court, but the same could not happen.
As such, again the court case filed by SNEA pending for final decision since 31/10/2024 and is not decided due to joint hearing along with another OA on the subject matter and continues to be undecided & pending for last fourteen months, no reason on part of applicant.
Now both the cases are again posted for final hearing on 12/03/2026.
Let us pray that applicant in second case and respondent BSNL will be ready by for final hearing on 12/03/2026 and matter of Pay loss is decided by Honourable Court positively in favor of affected JTOs/ JAOs facing loss and all affected executives will get the long awaited justice.
